Professor Lee is entitled to his views in trying to draw a comparison between Scooniehill and Kingask.

He argues that because the council called in the Kingask development there was no inquiry and “all the arguments that led the Reporter to reject Scooniehill would have scuppered Kingask.”

That ignores the point that the council did not have the final say on the Kingask development. That lay with the First Minister who could have called in the application and ordered a public inquiry. The then First Minister, the late Donald Dewar did not do so as he was satisfied with the council’s handling of the application.
